LEARN AND PLAY HOORAY TERMS OF SERVICE

You cannot opt out of receiving transactional emails related to your purchases or account support.

4. USE OF CONTENT & DIGITAL PRODUCTS

All information, materials, functions, and Content contained on our website and digital products are our copyrighted property or the copyrighted property of our licensors or licensees. All Content is protected by United States and international copyright, trade secret, or other intellectual property laws. All Learn and Play Hooray trademarks, service marks, trade names, and trade dress are proprietary to us.

Personal Use: Except as specifically agreed in writing, no Content may be reproduced, transmitted, distributed, or exploited. Where an Application or purchase enables downloading particular Content, you may download one copy for your personal, non-commercial home use.
Educator & Classroom License: Purchasers of digital curriculum packs, activity sheets, and lesson guides are granted a single-teacher, non-exclusive, non-transferable license to use the materials solely in connection with their direct classroom instruction, events, and educational activities. Sharing, re-selling, publicly broadcasting, uploading to shared drives, or sub-licensing digital files to third parties is strictly prohibited.

5. GEOGRAPHIC TERRITORY RESTRICTIONS

Learn and Play Hooray reserves the right to limit sales and service availability based on geographic location.

North Carolina Territory Exclusion: All digital curriculum products, activity packs, lesson plans, and proprietary teaching materials offered on this site are strictly non-licensed and unavailable for purchase or commercial use by individuals, educators, or entities residing in, operating in, or offering early childhood music and movement services within the State of North Carolina.
By purchasing digital content on this site, you explicitly represent and warrant that you and your business operate outside the State of North Carolina. Learn and Play Hooray reserves the right to cancel orders, revoke access, or rescind licenses for any purchases originating from or intended for use within North Carolina.
Service Availability: Access to online services may depend on internet connection and location. Learn and Play Hooray is not responsible for outages or internet performance issues.

6. APPLICATION & DIGITAL SERVICES

Users must be at least 18 years old (or the legal age to form a binding contract) to purchase products or create an account. Learn and Play Hooray reserves the right to change or update its products, pricing, delivery methods, and availability at any time without prior notice.

7. YOUR PROMISES TO LEARN AND PLAY HOORAY

Copy & Distribution Restrictions: Unless you obtain express written consent from Learn and Play Hooray, you are NOT ALLOWED to:

Electronically transfer, forward, or share purchased digital files with third parties
Reverse engineer, decompile, or modify our digital products or website features
Rent, lend, re-sell, publicize, broadcast, or distribute our curriculum packs
Create derivative works based on our proprietary songs, lesson guides, or activity sheets
Use our Services on behalf of multiple un-licensed users under a shared account login

Harmful or Illegal Use: You agree not to engage in any activity that interferes with or disrupts our Services, circumvents website security measures, collects user data without authorization, or provides false information during checkout or registration.

8. ACCOUNT SECURITY

9. CONTACTING YOU

Learn and Play Hooray will never contact you requesting sensitive account credentials outside of our secure website or application interface. Never open suspicious links claiming to be from Learn and Play Hooray.

11. ACCOUNTS & TERMINATION

You agree to provide true, accurate, current, and complete registration and checkout data. You shall not impersonate any person or misrepresent your affiliation or location. You agree to notify us immediately at LearnandPlayHooray@gmail.com of any unauthorized account activity.

We reserve the right to suspend or terminate your account or revoke digital product access for failure to comply with this Statement, copyright infringement, violation of geographic territory restrictions, or any other unauthorized use.

Intellectual Property & Non-Compete Policy

All proprietary curriculum, lesson plans, musical arrangements, visual materials, and instructional methods provided by Learn and Play Hooray LLC are protected by copyright and intellectual property laws.

Personal & Family Use Only: All classes, activities, concepts, and materials are provided strictly for the personal enrichment of enrolled participants and their families.
Prohibition of Commercial Exploitation: You agree not to record, duplicate, adapt, publish, perform, or use any proprietary curriculum, class structures, songs, props, or instructional materials for commercial purposes, financial gain, or the creation of a competing business or service.
Information Gathering: You confirm that your attendance is strictly for family participation and not for market research, competitive analysis, or copying proprietary business practices.
Protection of Rights: Learn and Play Hooray LLC retains all exclusive rights, title, and ownership of all intellectual property created, presented, or distributed during any class or event.

Refund and Make Up Class Policy

Refunds & Class Make-Ups

Once registration and payment are completed, all sales are final and no monetary refunds will be issued.

Make-Up Classes: If you miss a regular class, you are encouraged to schedule a make-up session during any open class offered within a 4-week window.
Expiration: Unused make-up classes expire after 4 weeks and cannot be rolled over. All make-up classes are subject to space availability.

Sibling Fee Any non-registered sibling who is 1 year or older and attends a class session is subject to a drop-in fee of $28.50 per class.

Inclement Weather & Facility Closures

Inclement Weather: In-person make-up classes are not provided for cancellations due to inclement weather. Instead, a live online class will be hosted on the day of the missed class whenever possible (provided power and internet are available).
Facility Closures: If a partner facility or community center is closed or unavailable on your regularly scheduled class day, you are welcome to join another upcoming class session as a make-up.

Subscription Cancellations & Pauses

To Cancel: Written notice must be submitted via email at least 30 days prior to your next billing date. Cancellations received after this window will apply to the following billing cycle. Refunds are not provided for partial billing periods.
To Pause: You may pause your subscription for up to two consecutive months. Automatic monthly billing will resume in the third month.

Learn and Play Hooray Digital Product Policy

LEARN AND PLAY HOORAY DIGITAL PRODUCT POLICY

1. ALL SALES ARE FINAL (NO REFUNDS) Due to the immediate access and non-returnable nature of downloadable files, all digital product purchases—including curriculum packs, printable activity sheets, lesson plans, and audio files—are non-refundable. Once payment is complete and download links or files are delivered, no monetary refunds, exchanges, or store credits will be granted under any circumstances.

2. SINGLE-TEACHER DIGITAL LICENSE Every digital product purchase grants you a limited, non-exclusive, non-transferable, single-user license for personal or individual classroom use only.

Allowed: Printing copies for your own direct classroom students, homeschool children, or hosted enrichment events.
Prohibited: Sharing, forwarding, emailing, re-selling, or uploading digital files to shared drives, social media groups, or school-wide servers. Each educator must purchase their own license.

3. GEOGRAPHIC TERRITORY RESTRICTIONS All digital curriculum products and teaching packs are strictly non-licensed and restricted from purchase or commercial use by individuals, businesses, or entities residing in, operating in, or offering early childhood music and movement services within the State of North Carolina. By completing a purchase, you certify that you operate outside of North Carolina. Learn and Play Hooray reserves the right to void licenses and cancel orders that violate this territorial restriction.

4. DIGITAL DELIVERY & ACCESS Upon successful payment, download links will be delivered instantly on the checkout confirmation page and sent to the email address provided at checkout. You are responsible for downloading and saving files to your personal device immediately upon receipt. Learn and Play Hooray is not responsible for lost or deleted files after initial delivery.

5. FILE INTEGRITY & TECHNICAL REQUIREMENTS Digital products are delivered in standard file formats (such as PDF, PNG, or MP3). You are responsible for ensuring your device supports these standard formats. If you encounter a corrupted file link or download error, please contact us within 14 days of purchase at LearnandPlayHooray@gmail.com with your order details, and we will resend your download link.
